It\u2019s called your domicile. It\u2019s usually your father\u2019s domicile, but if your parents weren\u2019t legally together when you were born, then your mother\u2019s domicile decides it. While the topic is vague (and as ever from HMRC, quite complicated), just know that it\u2019s separate from your nationality, citizenship, or residence.&nbsp;<\/p>\n\n\n\n<p>Let\u2019s take a look at this example to wrap our heads around it.<\/p>\n\n\n<\/div> <!-- .c-body -->\n\n<div class=\"b-highlight-mini m-nude m-align-left\">\n    <div class=\"b-block-body\">\n        <h3>Example \ud83d\udcdd<\/h3>\n<p>Leilah\u2019s mum is from Spain and her dad is from Morocco. Her parents are married and they have moved to the UK, where they\u2019ve lived for the past 10 years, however their domiciles still remain Spain and Morocco, respectively.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p>When Leilah was born, both their domiciles of choice were the UK. Leilah\u2019s domicile of origin is therefore now the UK. After university, Leilah decides she wants to move to Spain permanently with her new partner. They plan to have children there and are looking to buy their first home as soon as they move over.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p>Leilah would like to acquire a domicile of choice.<\/p>\n\n    <\/div>\n<\/div> <!-- .b-highlight-mini -->\n\n<div class=\"c-body\">\n\n\n\n\n<h2 class=\"wp-block-heading\">And what about domicile of choice?<\/h2>\n\n\n\n<p>A domicile of choice is essentially just changing your domicile from your domicile of origin to another country. When you decide you want to acquire a domicile of choice, two things need to happen:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You need to make your intention clear&nbsp;<\/li>\n\n\n\n<li>You&nbsp; need to have permanent residence in the country you\u2019ve chosen&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>These are the minimum requirements that would allow the government to consider your new home as your domicile of choice. Here\u2019s how it works:<\/p>\n\n\n\n<p>Clear intention<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You need to be committed to living in the new country for the indefinite future as a permanent citizen and not intend to come back to the UK.<\/li>\n<\/ul>\n\n\n\n<p>To do this, you need to demonstrate that you intend to remain in your chosen country indefinitely. This means minimising your connections with the UK, or your domicile of origin. *Cue dramatic music*<\/p>\n\n\n\n<p>Residency<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Domicile of choice can only be acquired if you\u2019re a tax resident in your new country and intend to make it your permanent home.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n<\/div> <!-- .c-body -->\n\n<div class=\"b-highlight-mini m-yellow m-align-left\">\n    <div class=\"b-block-body\">\n        <h3>There are many reasons you might want to change your domicile, aside from tax purposes. Here are a few examples of some \u201cwhys\u201d:<\/h3>\n<h3><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/h3>\n<p>\u2192 You&#8217;ve always wanted to live in a specific country (hello sun, sand and sea \ud83c\udf0a)<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p>\u2192 You want to move closer to your family, perhaps to take care of a relative<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p>\u2192 You want to raise a family elsewhere to provide better opportunities<\/p>\n\n    <\/div>\n<\/div> <!-- .b-highlight-mini -->\n\n<div class=\"c-body\">\n\n\n\n\n<p>There\u2019s no amount of time you should wait to start the process, which can sometimes take years. And you only need to be intentional in your actions to leave the UK and reside elsewhere.<\/p>\n\n\n\n<p>Here\u2019s what we mean.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are declarations of intentions<\/h2>\n\n\n\n<p>It\u2019s easy to say \u201cI\u2019m deciding to make this my permanent home\u201d and then just get on with it. But unfortunately, this alone isn\u2019t good enough to change your domicile. You must <em>prove<\/em> that this new country is the one you plan to settle in.<\/p>\n\n\n\n<p>Some examples include:<\/p>\n\n\n<\/div> <!-- .c-body -->\n\n<div class=\"b-columns-mini m-align-left\">\n    <div class=\"b-columns-mini__container\">\n\n        \n        \n        <div class=\"b-columns-mini__item m-blue\">\n                                    \n            <div class=\"b-columns-mini__item-content\">\n                <div class=\"b-block-body\">\n                    <ul>\n<li>Buying property<\/li>\n<li>Starting a business<\/li>\n<li><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/li>\n<li>Opening a bank account for earned local income<\/li>\n<li><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/li>\n<li>Acquiring burial plots to plan for the future<\/li>\n<\/ul>\n\n                <\/div>\n            <\/div>\n        <\/div>\n\n        \n        \n        <div class=\"b-columns-mini__item m-blue\">\n                                    \n            <div class=\"b-columns-mini__item-content\">\n                <div class=\"b-block-body\">\n                    <ul>\n<li>Getting a job and paying local taxes<\/li>\n<li><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/li>\n<li>Joining local clubs\/associations<\/li>\n<li><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/li>\n<li>Making a will subject to local law<\/li>\n<\/ul>\n\n                <\/div>\n            <\/div>\n        <\/div>\n\n        \n        \n    <\/div>\n<\/div> <!-- .b-columns-mini -->\n\n<div class=\"c-body\">\n\n\n\n\n<p>It\u2019s all these considered together that allow you to officially \u201cbelong\u201d somewhere else. With these declarations and your actions, the government will make a decision as to whether or not you can acquire a domicile of choice.<\/p>\n\n\n\n<p>HMRC may launch an enquiry about your status and may require various questions answered and documents from you. You can <a href=\"https:\/\/www.gov.uk\/hmrc-internal-manuals\/residence-domicile-and-remittance-basis\/rdrm23080\" target=\"_blank\" rel=\"noreferrer noopener\">find the full list here<\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What does domicile of choice have to do with tax?<\/h2>\n\n\n\n<p>Good question. If you\u2019re trying to shed your domicile of origin, you need to be committed. There are things you can do, like the declarations of intention, that act as evidence that you intend to make the overseas country your domicile of choice.&nbsp;<\/p>\n\n\n\n<p>If you acquire domicile of choice outside the UK:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You are no longer required to pay UK taxes (woohoo!)<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You will have to pay taxes in the country where you reside (sob)<\/li>\n<\/ul>\n\n\n\n<p>If your domicile of origin is the UK, you will be liable to the usual taxes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Income Tax<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Capital Gains Tax<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/taxfix.com\/en-uk\/glossary\/inheritance-tax-iht-allowance\/\">Inheritance Tax<\/a> (IHT) &#8211; even on any global assets<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"embed-container\"><iframe loading=\"lazy\" title=\"Tax in 10(ish) seconds - what is Income Tax?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/ttQypqUVjQs?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s Inheritance Tax got to do with anything?<\/h2>\n\n\n\n<p>Once your domicile is no longer the UK, the 40% IHT rate no longer applies to your assets abroad.&nbsp;<\/p>\n\n\n\n<p>If someone with a domicile of choice outside of the UK dies, they would only have to pay UK taxes on assets in the UK. These include taxes on their UK property or bank accounts, but nothing abroad.&nbsp;<\/p>\n\n\n\n<p>However if your domicile is considered the UK, you pay UK taxes on all your worldwide assets. If you own properties globally, you\u2019re subject to 40% IHT on each one. There is a \u00a3325,000 tax-free IHT allowance, so it\u2019s worth taking advantage of it!<\/p>\n\n\n\n<p>If you\u2019re a <a href=\"https:\/\/taxfix.com\/en-uk\/glossary\/non-domiciled\/\">non-domiciled person<\/a>, you probably won\u2019t need to pay UK tax. You just have to satisfy <a href=\"https:\/\/taxfix.com\/en-uk\/glossary\/non-domiciled\" target=\"_blank\" rel=\"noreferrer noopener\">these<\/a> conditions. You might be liable to pay UK taxes depending on your status, which we\u2019ve clarified below.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Residency&nbsp;<\/strong><\/td><td><strong>Domicile&nbsp;<\/strong><\/td><td><strong>Liable to pay UK taxes<\/strong><\/td><\/tr><tr><td>Non-UK<\/td><td>UK<\/td><td>Yes<\/td><\/tr><tr><td>UK<\/td><td>UK<\/td><td>Yes<\/td><\/tr><tr><td>UK<\/td><td>Non-UK<\/td><td>No<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">What happens if I leave my domicile of choice?<\/h2>\n\n\n\n<p>In situations where your domicile of choice is no longer a permanent option, your domicile of origin is activated. If you leave your domicile of choice to a country other than your domicile of origin, you can acquire domicile of choice for the new country.
