Executors are entitled to a Capital Gains tax allowance that is separate from their personal CGT allowance.<\/p>\n\n\n\n<p>As an executor, your Capital Gains Tax allowance is currently \u00a33,000 for the 2024\/25 tax year.<\/p>\n\n\n\n<p>This means you can dispose of their assets up to this value, within this tax year, and not pay any CGT. Anything over \u00a33,000 would be liable for Capital Gains Tax.<\/p>\n\n\n\n<p>Your executor CGT allowance applies for the tax year they passed away along with the following two tax years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What rate of Capital Gains Tax is payable by executors?<\/h2>\n\n\n\n<p>The rate of CGT for executors depends on the asset. <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Sales of residential property &#8211; 24%<\/li>\n\n\n\n<li>Any other assets &#8211; 20%<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How to calculate Capital Gains Tax<\/h2>\n\n\n\n<p>When working out CGT as an executor, you\u2019ll need to consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The acquisition cost &#8211; this is the value of the asset at the date of their death<\/li>\n\n\n\n<li>The total of all asset sales made in the tax year &#8211; including any losses<\/li>\n<\/ul>\n\n\n\n<p>You\u2019ll also need to deduct the cost of selling the asset from the capital gain.<\/p>\n\n\n<\/div> <!-- .c-body -->\n\n<div class=\"b-highlight-mini m-nude m-align-left\">\n    <div class=\"b-block-body\">\n        <p><b>Let\u2019s simplify things! <\/b><span style=\"font-weight: 400;\">If you sell the property as an executor and make a profit of \u00a3300,000, then \u00a33,000 of the sale is exempt from Capital Gains Tax.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Capital Gains Tax is payable on the remaining \u00a3297,000 at a rate of 28% &#8211; meaning \u00a371,280 Capital Gains Tax is due from the sale of the property.<\/span><\/p>\n\n    <\/div>\n<\/div> <!-- .b-highlight-mini -->\n\n<div class=\"c-body\">\n\n\n\n\n<h2 class=\"wp-block-heading\">Can Taxfix take care of this?<\/h2>\n\n\n\n<p>Navigating Capital Gains Tax can be tricky for executors.
