There are, however, tax implications attached to being an online influencer.<\/p>\n\n\n\n<p>To be an influencer, you have to declare your earnings to HMRC, whether you influence part-time or if it accounts for your full-time livelihood. If your earnings exceed a certain threshold, you will owe tax on them as well.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a content creator?<\/h2>\n\n\n\n<p>First things first, let\u2019s define what we mean by content creator (or influencer). In the social media sense, an it&#8217;s someone who has the power to influence their (usually substantial and loyal) following to act in a certain way when prompted. They\u2019re used by brands for endorsement, to boost their product sales and\/or to increase their following.&nbsp;<\/p>\n\n\n\n<p>In 2022, <a href=\"https:\/\/amateurphotographer.com\/latest\/photo-news\/adobe-future-of-creativity-uk-content-creators\" target=\"_blank\" rel=\"noreferrer noopener\">1 in 4 Brits<\/a> described themselves as content creators. That\u2019s 25% percent of the UK. By anyone\u2019s estimation, that\u2019s a pretty big reach.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What tax do influencers owe?<\/h2>\n\n\n\n<p>As with all self-employed workers, influencers are entitled to a tax-free <a href=\"https:\/\/taxfix.com\/en-uk\/glossary\/personal-allowance\/\">Personal Allowance<\/a> of up to \u00a312,570 per year. Owing to the level of swaying power that they have on what we buy, where we holiday, the products we use etc., the CMA put some guidelines in place.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.gov.uk\/government\/news\/celebrities-pledge-to-clean-up-their-act-on-social-media\">\u201cThe CMA considers payment to be any form of reward, including money, gifts of services or products, or the loan of a product.\u201d<\/a>&nbsp;<\/p>\n\n\n\n<p>They also consider freebies \u2013 even when a product is sent without prior warning \u2013 to be a form of payment.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Did it work?<\/h2>\n\n\n\n<p>As you can imagine, this can make taxing difficult.&nbsp;<\/p>\n\n\n\n<p>Where a contract is involved or an influencer invoices for their services, it\u2019s easy to calculate where tax is due. A payment-in-kind is a payment in return for a service or goods that isn\u2019t cash.&nbsp;<\/p>\n\n\n\n<p>If, instead of being paid in cash, an influencer is paid in clothes, holidays, protein shakes, skincare products or anything else \u2018gifted\u2019 in exchange for endorsement, you can be liable to pay tax for the monetary value of the transaction.&nbsp;<\/p>\n\n\n\n<p>If you\u2019re gifted a yachting experience, for example, you could owe tax on the cash equivalent.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who\u2019s affected?<\/h2>\n\n\n\n<p>These rules are most likely to affect high-profile influencers, but you should be mindful of them whatever the size of your following. You could end up paying tax on items for which you never actually received cash payment.<\/p>\n\n\n\n<p>If you\u2019re considered to be \u2018trading\u2019, you\u2019ll be liable.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a trading influencer?<\/h2>\n\n\n\n<p>To murky the waters further, trading isn\u2019t specifically defined by HMRC for influencers. As a guideline, let\u2019s look at how a literary author would be considered trading.&nbsp;<\/p>\n\n\n\n<p>The Institute of Chartered Accountants in England and Wales explain that if you organise your life to regularly spend time writing to produce work with commercial value, and strategically market it for your financial benefit, you are considered to be trading.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Are all influencers considered trading influencers?<\/h2>\n\n\n\n<p>Nope. For influencing, if it\u2019s one of your main sources of income and you organise your life to regularly spend time working on posts with commercial value, and share them for your own financial benefit, you\u2019ll be considered to be trading.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How do I cover myself as an influencer?<\/h2>\n\n\n\n<p>Basically, it\u2019s important to try to secure written agreements that set out your relationship with brands. This makes recording your work easier and provides you with hard evidence of your income should HMRC come knocking.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can you claim expenses?<\/h2>\n\n\n\n<p>Like all self-employed workers, influencers can deduct expenses from their tax bill.
