If you\u2019re lucky enough to receive a gift of high value, the down side is that there are some gift tax implications to consider.<\/p>\n\n\n\n<p>Here are the basic rules:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the person gifting you passes away within 7 years, you may need to pay <a href=\"https:\/\/taxfix.com\/en-uk\/inheritance-tax-rates-allowances\/\">Inheritance Tax<\/a> (but this isn\u2019t always the case, continue reading)<\/li>\n\n\n\n<li>If you\u2019re receiving an asset that has increased in value since the person giving it to you bought it, then they\u2019ll usually need to pay <a href=\"https:\/\/taxfix.com\/en-uk\/capital-gains-tax-on-gifted-property\/\">Capital Gains Tax<\/a> when they\u2019re giving it to you<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"embed-container\"><iframe loading=\"lazy\" title=\"Tax in 10(ish) seconds - what is Capital Gains Tax?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/ZUdtnBFew8o?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">What counts as a gift?<\/h2>\n\n\n\n<p>Anything that you are given that has value is classed as a gift, i.e:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Large sums of money<\/li>\n\n\n\n<li>Cars<\/li>\n\n\n\n<li>Fine jewellery<\/li>\n\n\n\n<li>Property<\/li>\n\n\n\n<li>Art<\/li>\n<\/ul>\n\n\n\n<p>In the case of a capital loss, you may still be subject to gift tax.<\/p>\n\n\n\n<p>Example:<\/p>\n\n\n\n<p>Your parents own a flat worth \u00a3250,000 and they generously sell it to you for a special price of \u00a3150,000; the \u00a3100,000 they lose on the sale actually counts as a gift \u2013 you may still have to pay estate tax on this.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How much can you gift tax-free?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cash gifts of up to \u00a33,000 each tax year<\/li>\n\n\n\n<li>Some <a href=\"https:\/\/www.gov.uk\/inheritance-tax\/gifts\">wedding gifts to your family<\/a><\/li>\n\n\n\n<li>Any gift worth \u00a3250 or less \u2013 however, this doesn\u2019t count if you\u2019ve already used your full \u00a33,000 annual exemption<\/li>\n\n\n\n<li>Money to help cover living costs for a child,  ex-spouse, or someone who is old. <\/li>\n<\/ul>\n\n\n\n<p>On the bright side, some gifts are completely exempt from inheritance tax:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You won\u2019t have to pay tax on any gift from your spouse or civil partner &#8211; so no, you won\u2019t have to spend the day after your birthday on the phone to HMRC!<\/li>\n\n\n\n<li>Any gift from any person, as long as that person lives for another 7 years after gifting it to you<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How much do I need to pay?<\/h2>\n\n\n\n<p>Inheritance Tax has a flat rate of 40% which certainly makes things a little less confusing if you do need to pay. Find out more about how this rate is calculated <a href=\"https:\/\/taxfix.com\/en-uk\/the-tax-basics\/inheritance-tax-rates-allowances\/\">here<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How do I pay the tax on gifts?<\/h2>\n\n\n\n<p>If you receive a gift three or more years before the gifters death, consider yourself lucky as you will be entitled to <a href=\"https:\/\/www.gov.uk\/inheritance-tax\/gifts\">taper relief<\/a> which is calculated depending on the number of years between the gift and death:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Years between gift and death<\/strong><\/td><td><strong>Rate of tax on the gift<\/strong><\/td><\/tr><tr><td>3 to 4 years<\/td><td>32%<\/td><\/tr><tr><td>4 to 5 years<\/td><td>24%<\/td><\/tr><tr><td>5 to 6 years<\/td><td>16%<\/td><\/tr><tr><td>6 to 7 years<\/td><td>8%<\/td><\/tr><tr><td>7 or more<\/td><td>0%<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">How do I pay the tax on gifts?<\/h2>\n\n\n\n<p>When your benefactor passes away, their lawyer or an entrustee will usually sort the desk work out for you.
