There are different factors that affect how a property is viewed in tax terms.&nbsp;<\/p>\n\n\n\n<p>If you rent out a <a href=\"https:\/\/www.gov.uk\/government\/publications\/furnished-holiday-lettings-hs253-self-assessment-helpsheet\" target=\"_blank\" rel=\"noreferrer noopener\">Furnished Holiday Let (FHL)<\/a>, HMRC sees this as a trade rather than a property business. A property business, in contrast, is an investment business. And this is treated very differently in tax terms.&nbsp;<\/p>\n\n\n<\/div> <!-- .c-body -->\n\n<div class=\"b-columns-mini m-align-left\">\n    <div class=\"b-columns-mini__container\">\n\n        \n        \n        <div class=\"b-columns-mini__item m-nude\">\n                                    \n            <div class=\"b-columns-mini__item-content\">\n                <div class=\"b-block-body\">\n                    <h3>A trade<\/h3>\n<p>Defined as \u201cany venture in the nature of trade\u201d, based on certain commercial services being offered<\/p>\n\n                <\/div>\n            <\/div>\n        <\/div>\n\n        \n        \n        <div class=\"b-columns-mini__item m-purple\">\n                                    \n            <div class=\"b-columns-mini__item-content\">\n                <div class=\"b-block-body\">\n                    <h3>A property business<\/h3>\n<p>Profits from UK land or property involved in running a \u2018rental business\u2019<\/p>\n\n                <\/div>\n            <\/div>\n        <\/div>\n\n        \n        \n    <\/div>\n<\/div> <!-- .b-columns-mini -->\n\n<div class=\"c-body\">\n\n\n\n\n<p>If your property is classed as a FHL, you will be able to claim certain tax benefits:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><a href=\"https:\/\/taxfix.com\/en-uk\/glossary\/capital-gains-tax-allowance\/\" target=\"_blank\" rel=\"noreferrer noopener\">Capital allowances<\/a> &#8211; you can claim these allowances to help you cover the cost of kitting out your property<\/li><li>Tax-advantaged pension contributions<\/li><li><a href=\"https:\/\/www.gov.uk\/apply-for-business-rate-relief\/small-business-rate-relief\">Small Business Rate relief<\/a> &#8211; which can enable you to not pay council tax on your FHL<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What makes something a Furnished Holiday Let?<\/h2>\n\n\n\n<p>An important distinction made is whether you are making profit from the use of the land or from the services forming part of a trade. If your service is more like that of a hotel, it will more likely qualify for the latter.&nbsp;<\/p>\n\n\n\n<p>Below is a selection of services and conditions that qualify a property as a Furnished Holiday Let:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Be available to let at least 210 days of the first tax year you start trading (even if you don\u2019t host guests for that many days)<\/li><li>You can\u2019t allow stays longer than 31 days<\/li><li>It must be commercially let as a holiday property for at least 105 days (unless you\u2019re based in Greater London &#8211; scroll down to \u2018<em>The 90 night rule\u2019<\/em> to read more)<\/li><li>FYI you can\u2019t count days that either you or your friends\/family are occupying the property for free or for mates\u2019 rates<\/li><li>You must furnish the property<\/li><\/ul>\n\n\n\n<p>Read more about <a href=\"https:\/\/www.gov.uk\/government\/publications\/furnished-holiday-lettings-hs253-self-assessment-helpsheet\/hs253-furnished-holiday-lettings-2018\" target=\"_blank\" rel=\"noreferrer noopener\">FHL on the HMRC website<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The 90 night rule<\/h2>\n\n\n\n<p>When you host a property in London, there\u2019s a rule that restricts you from hosting for more than 90 days during a calendar year. This is because when you turn residential property into a rental in London, you need to get <a href=\"https:\/\/www.london.gov.uk\/what-we-do\/housing-and-land\/improving-private-rented-sector\/short-term-and-holiday-lets-london\" target=\"_blank\" rel=\"noreferrer noopener\">planning permission<\/a>. This planning permission is known as <em>change of use<\/em>; however, it only affects properties that are rented for more than 90 nights of the calendar year.&nbsp;<br>If you do want to host for longer than 90 nights in a year, you will have to apply for planning permission to do so. Otherwise, the cap will be applied to your property automatically. Whatever you\u2019re renting out, you\u2019ll owe tax like anyone else. Here are some of the more niche accommodations that you may not have considered in terms of tax purposes.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.
